A GUIDE TO UNDERSTANDING PERSONAL INJURY AND WRONGFUL DEATH CASES

What is a personal injury case?
A personal injury case is a claim for damages by a person who has been injured in an accident caused by someone else's carelessness. Personal injury claims can arise out of automobile or truck accidents, dangerous and defective products (product liability cases), by a careless medical provider (medical malpractice cases), or by a landowner who has failed to keep the property in a safe condition (premises liability cases). A wrongful death arises from the death of a person caused by the wrongful act of another.

What can you recover if you've been injured?

The legal system provides a method of recovering money damages to compensate you for your losses. Damages may include repair or replacement of your car, medical expenses, lost wages, and damages for a permanent injury if it will affect you the rest of your life. If your spouse, child, or parent has died as a result of the negligent act of someone else, you may have the right to recover money damages for the loss of your loved one.

What does it cost to hire an attorney?

To minimize out-of-pocket legal expenses for our clients, we can handle personal injury cases on a contingent-fee basis, meaning that our fee is based on a percentage of the money we recover for you through settlement or trial.

Will my case settle?
There are no guarantees any case will settle. While many cases do settle before trial, many personal injury cases must be filed in court and pursued diligently in litigation before settlement. The best way to achieve a fair settlement is to properly prepare the case for trial: investigate the facts, review the medical treatment, calculate the provable damages, and analyze the risks and potential benefits of placing the case before a jury. Ultimately, the decision on whether to settle rests with the client. We strive to keep you fully informed so that when you have to make that decision, you understand all the risks and benefits.
